कल हमने लिखा आई आई २० के बारे में। हमको पहले आई आई २० क्या है इसके बारे में बताना चाहिए था। वो मैं आपको आज बता रहा हूँ।

Implementation Instruction No.20
Sub : Social Security ( Chapter - X)

National Coal Wage Agreement- VIII finalized by the Joint Bipartite Committee by the Coal Industry on 24.01.2009 which has come into force w.e.f. 01.07.2006 provides the following in respect of Social Security ( Chapter IX ).
9.3.0, 9.4.0 & 9.5.0. Provision of Employment/payment of monthly monetary
compensation to dependant.

i) The Clauses 9.3.0, 9.4.0 & 9.5.0 of NCWA-VI will be operative in NCWA-VIII till a revised scheme is jointly prepared keeping in view the various verdict of Hon'ble Supreme Court at the earliest.
ii) A Sub-committee of JBCCI will formulate a scheme keeping in view various directives of Supreme Court on the subject within three months of signing of the Agreement.
iii) Meanwhile provision of employment as mentioned at (i) above, shall be on basic wage of Cat.I as trainee for a period of 6 months. During the training period they will have the status of permanent employee. On completion of training they shall be regularised as Cat.-I employee.
iv) The monthly monetary compensation payable to the female dependant in case of death either in mine accident or for other reasons or medical unfitness of the employee shall be @ Rs.6000/- with effect from 1.5.2008.
v) In case of death either in mine accident or due to other reasons or medical unfitness, if no employment has been offered and the male dependant of the concerned worker is 12 years and above in age, he will be kept on a live roster and would be provided employment commensurate with his skill and qualifications when he attains the age of 18 years. During the period the male dependant is on live roster, the female dependant will be paid monetary compensation as given in (iv) above.
You are requested to take necessary action to implement the above provisions.

इसी सर्कुलर के बारें में हमने लिखा। इसके कलोज़ १) और २) पर आपत्ति है। हम नहीं चाहते हैं की आज जो मृत्यु या अनफिट के बदले आश्रित को नौकरी मिलती है उसमें किसी प्रकार की कतोत्ति हो। उपरोक्त प्रावधान आश्रित के नौकरी मिलने के अधिकार को सिमित करने की दिशा में एक कदम है इसलिए हम इसका विरोध कर रहें हैं और इसका विरोध होना चाहिए। आज सभी नेता दस प्रतिशत विनियोग का विरोध कर रहें है। यह मामला उतना बरा नहीं है जितना बरा बनाया जा रहा है। मार्केट में दस % शेयर आ जाने से कुछ नहीं होने वाला है बल्कि जो मजदूर शेयर रखेंगे उसका लाभ ही होगा। विरोध तो उपरोक्त प्रावधान का होना चाहिए जिसमे मजदूरों का एक अधिखर छिना जा रहा है। नेता भले ही ध्यान नहीं दे हम जागरूक हैं इसलिए हमें ध्यान देना चाहिए। और बातें दुसरे दिन.

आई आई २० - (१)

कोयला वेतन समझोता ८ का आई आई २० निर्गत हो चूका है । इसका मूल उद्देश्य है की आज जो मजदूरों को ९.३.०, ९.४.० और ९.५० के तहत आश्रित को नौकरी मिलने की बात है उस प्रावधान को समाप्त करना। इस सर्कुलर के खिलाफ मैंने विरोध किया। निदेशक कार्मिक कोल इंडिया को पत्र लिखा लेकिन कोई जवाब नहीं मिला। फिर मैंने आर टी आई के तहत जानकारी ली तो पता चला उच्च प्रबंधन आश्रित को नौकरी देने के पक्ष में नहीं है। जेबिसिसिआइ में बठने वाले नेताओं ने उपरोक्त प्रावधान लाकर गलत किया है। उपरोक्त प्रावधान किसी भी रूप में नहीं होना चाहिए था। नेताओं को गलती सुधरने का एक मौका है की वो सब कमिटी में कोई भी स्कीम बनाने के लिए नहीं बैठे अन्यथा कोयला उद्द्योग के मजदूर इस अन्याय को सहन नहीं करेंगे।

मैं कोयला उद्योग के मजदूरों को यही कहना चाहूँगा की वो अपने अधिकारों के प्रति सचेत रहे नहीं तो आपके अधिकार खतरें में पर जायेंगे। आज जमाना ये है की मजदूरों की दशा और दिशा में सुधर होना चाहिए न की कटोती। आप अपने union नेता से ज्यादा अपने पर भरोसा रखें अन्यथा ये union नेता आपको और आपके अधिकारों को बेंच देंगे। धन्यवाद्। आगे भी मैं आपको लिखता रहूँगा.

आज पता चल रहा है की पूरा भारत भ्रष्टाचार में डूब गया है। हर व्यक्ति लगता है की वह पैसे से बिक जाना चाहता है और बिक भी जाता है। पेपर और टीवी में निंदा प्रसारित होने के बाद भी कोई फर्क नहीं पड़ता है। आज ऐसा लगता है कि इस देस के लिए कोई कुछ करना ही नहीं चाहता है वह तो बस अपने लिए ही कुछ करना चाहता है। ऐसी बिगड़ी हुई हालत में अगर मैं यह कहूँ कि मैं इस हालत को संभालना चाहता हूँ तो क्या लोग मेरी बात को समझ पाएंगे? लोगों को समझाने के लिए तो पहले मुझे बात तो करनी होगी। बात करने के बाद ही तो यह पता लगेगा कि लोग मेरी बात को समझेंगे या मेरी हंसी उड़ायेंगे। जो मेरी क्षमता है वो बात तो मुझे पहले करनी ही होगी सो मैं यह बात करना चाहता हूँ। मुझे मत दो मैं तुम्हें सब दूंगा।

दास्ताँ गरीबी की

आज भी गरीबी ज्यों की त्यों है बल्कि बदती जा रही है । ताज्जुब की बात ये नहीं है की गरीबी बढती जा रही है ताज्जुब की बात ये है की गरीबी को दूर करनेवाला कोई नहीं आ रहा है। हाय रे भारत और हाय रे यह गरीबी। गरीबी का कलंक भारत से कब हटेगा कौन जाने। बहुत से लोगों ने प्रयास किये की भारत की गरीबी दूर हो मैं उनके प्रयोसों की काफी सराहना करता हूँ। मैं तो उन्हें ही धन्य कहूँगा जो भारत की इस गरीबी को हटना का प्रयास कर रहें हैं बाकि लोग तो राजनीती किस लिए कर रहें हैं यह जग जाहिर है। मैं एक आम मामूली आदमी मैं भी कुछ प्रयास करना चाहता हूँ और कुछ करूँगा। इतने बड़े देश के लिए मैं क्या कर सकता हूँ यह तो देखा जायेगा। लेकिन कुछ किया जाना चाहिए। मुझे विश्वास है की मैं भारत की गरीबी दूर कर सकता हूँ अतः मैं यह काम करूँगा। विधि क्या है वह मैं जानता हूँ । मेरी विधि से भारत की गरीबी जरुर दूर हो जाएगी। यदि मैं आगे के २५ साल जीवित रहा तो मैं जरुर बहुत कुछ कर सकता हूँ।

एक प्रयास और

जब भी भारत की गरीबी की खबर पढता हूँ तो मन मैं एक दर्द हो जाता है। सोचता हूँ की काश मैं कुछ कर पाता। भारत में प्रजातंत्र है और कोई भी काम प्रजातांत्रिक तरीके से ही किया जा सकता है। अतः मैंने सोचा की मैं यह काम राजनितिक तरीके से ही कर सकता हूँ। अतः मैंने यह फैसला किया की एक नई राजनितिक पार्टी का गठन किया जाये। अतः मैंने एक राजनितिक पार्टी का गठन किया है जिसका नाम है भारतीय लोकतान्त्रिक पार्टी । इस पार्टी के बारे में विस्तार से मैं आगे बताऊंगा.

Formation of new Political Party

I have decided to formulate a Political Party. I have named it Bhartiya Loktantrik Party i.e. Indian Democratic Party. The aim of this party will be to eradicat the poverty of India. I have full belief that niether the Congress Party nor BJP will eradicate the poverty. I am very much anxious to go through the articles of news papers about poverty in India. So I decided to do for this. I thought there is no way except forming a new Party otherwise my all efforts will go in vain . I know changing of system or society is very difficult and time taking but it is to be done by someone. I have decided it and I shall eradicate the poverty through political process. I hope the people of India will believe in me.

Delayed justice

We often criticize for delayed justice. But we do not try to go into the deep of the problem. We only complain the system. The population of India is enormous so certainly there will be large number of cases in courts. To meet the situation we should take action for increase of courts and judges. If number of courts and judges are increased then certainly there will be no complain of delayed justice. While doing for the sake of justice I found that majority people or workman do not desirous to go to the courts for redressal of their claims. They say in courts there will be delay. So I do not want to go to courts. Notwithstanding the facts that there have been much delay in deciding the issue what to do. The common people in India are unable to think that law is ultimate remedy. Courts in its decisions state that since there has been enormous delay so the claim cannot be entertained. At the moment this view of the court is to be communicated to all lay men. The common idea that in courts there will be delay is required to be changed. I went through numerous judgements in which justice is denied by the so called executive class or authorities who are required to extend the benefits as provided by laws. Such denial are required to be opposed vehemently. These denials or deprieving of rights are never to be accepted. If injustice is tolerated it will be hazardous to the democratic set up. You have to reject injustice straitway. In no way injustice or denial of any legal right should be left unopposed.

This should be strictly followed.
